After examining the case materials, after listening to the explanations of the representatives of the parties who appeared, assessing the evidence presented, the court recognized the application as not subject to satisfaction on the following grounds.

The Court considers that the applicant has not missed the deadline under Part 4 of Art. Section III. Proceedings in the arbitration court of first instance in cases arising from administrative and other public legal relations > Chapter 24. It follows from the materials of the case that the Federal Tax Service of Russia No. 22 for the city of Moscow, on the basis of Order No. 2 dated March 24, 2016, audited the compliance of State Sports Lotteries JSC with the requirements established by the Federal Law of November 11, 2003. No. 138-FZ "On lotteries" and other regulatory legal acts of the Russian Federation in the field of organizing and conducting lotteries.

During the audit, the fact of violation by the Company of clause 1 of Art. 12 of the Federal Law of November 11, 2003 No. No. 138-FZ "On lotteries" of the All-Russian State drawing lottery"VGL 4 Sport".

On May 27, 2016, the Inspectorate issued Order No. 1 “On the Elimination of Violations of Legislative Requirements” against the Company, which ordered the Company to eliminate the violations set forth in the inspection report dated May 27, 2016.
