For many new parents, child care allowance is an important financial aid. But what if the payment of benefits is delayed without explanation? Read about it in our new article!

When should the child benefit be paid?

In order to deal with this issue, it is necessary, first of all, to familiarize yourself with the law governing the payment of child benefits. So, according to Art. 15 of the Federal Law "On Compulsory Social Insurance in Case of Temporary Disability and in Connection with Maternity", the child care allowance must be paid no later than 10 days from the date of application for the grant.

As practice shows, this moment there are not many reasons to delay child benefits. Let's take a closer look at each of them.

If the benefit is delayed by the FSS, it is most likely the fault government agencies who lately transfer money from the federal or regional budget. As a rule, such delays do not exceed 1-2 months, and the benefit is paid immediately after regular funding is restored.

If the delay in child benefit occurs through the fault of the employer, in most cases this is due to the fact that the organization does not have enough working capital. In this case, the employer is obliged to apply to the FSS with an appropriate application. Based on his application, the Social Insurance Fund will conduct an audit, according to the results of which the necessary funds will be transferred to the company's account.

The birth of a child requires full dedication and attention from the mother. Naturally, at this time a woman does not work, because now she must devote herself to raising a baby. The state supports young parents with all available means. Improving the demographic situation in the country is one of the priorities of the government. All families with children under 1.5 years old are entitled to social benefits, which are paid monthly.

How many days after registration of documents to wait for payment? Why is there a delay in benefits if it has already been accrued? Where to call and apply if the money does not come?

What is the legal deadline for paying child support?

The allowance for caring for a child up to 1.5 years is usually paid to the mother. It doesn't matter if it's official or not. The amount of payments depends on medium size wages for the last two years or a living wage.

The transfer of the child care allowance is made by the Social Insurance Fund. Employed citizens apply at the place of their work, and unemployed - to the public service. The source of the child allowance is the budget, the employer only sends an application from his employee. The term of payments does not depend on the previous dates for the transfer of wages, it is the same for all citizens and is established at the state level.

The term for transferring benefits is up to the 26th day of the month, while the payment is made for the previous month. After submitting documents for receiving social benefits, it will be received within 10 days.

Why are payments delayed?

When benefits are transferred from the state budget, delays in transfers are not uncommon. Do not worry about a slight delay in money, the parents will definitely receive the due funds.

Sometimes a shift in the date of transfer of child allowance occurs due to coincidence with a holiday or weekend. On the first working day, it is charged as expected. The Social Insurance Fund officially announces possible delays and announces the payment deadline. The maximum period for which the child allowance is delayed does not exceed 1-2 months.

Now such situations happen infrequently and are typical mainly for the regions. In metropolitan areas, payments are made regularly.

Where to apply in case of delay and how to apply?

Long delays in payments violate the rights and interests of minors, and this is a good reason for a detailed investigation and punishment of those responsible. If the child benefit has not arrived within two months, citizens can apply to the following authorities:

The first step will be to submit an application to the FSS, because it is this body that transfers benefits. There is no general sample of the complaint, so the appeal is filled in free form.

The application must indicate:

  • your data (last name, first name, patronymic, place of registration, telephone number);
  • detailed substantiation of the complaint;
  • the requirement to pay the due allowance, indicating the legislative standards;
  • application list;
  • date and signature of the applicant.

A lawyer can help you draft a proper appeal. This significantly increases the chances of getting a response from the public service and a positive resolution of the situation.

Written appeals do not go unanswered, because the next stage may be the prosecutor's intervention or the court.

The completed application is transferred to the authorities that control the payment of children's money, namely the FSS. One copy of the complaint is submitted for consideration, and a mark on receipt and acceptance for work is affixed on the second form. In this way, public service it will not be possible to “lose” or ignore the appeal of a citizen.

You can send the application by registered mail by Russian Post or courier service. In both cases, the applicant will have confirmation of the transfer of his appeal. Be sure to specify how the response to the complaint should be sent. It is better to demand an official written response - this document will become fundamental in further proceedings.
